This study aimed to explore experiences and practices of key research team members in obtaining informed consent for pharmacogenetics research and to identify the approaches used for enhancing understanding during the consenting process. Data collection involved 15 qualitative, in-depth interviews with key researchers who were involved in obtaining informed consent from HIV infected individuals in Uganda for participation in pharmacogenetic clinical trials. The study explored two prominent themes: approaches used to (...) convey information and enhance research participants’ understanding and challenges faced during the consenting process. Several barriers and facilitators for obtaining consent were identified. This essay describes and critically evaluates a co-operative educational program to train Ugandan health care workers in bioethics. It describes one bottom-up effort, a week-long intensive workshop in bioethics provided by the authors to health care professionals in a developing country—Uganda. We will describe the background and circumstances that led to the organization of the workshop, and review its planning, design, curriculum, and outcome. We will focus especially on measures taken to make the workshop relevant for the audience of Ugandan (...) professionals, and describe lessons learned after two presentations of the workshop. Finally, we will discuss the strengths and weaknesses of such a format, and its potential value in raising bioethical expertise in developing countries. (shrink)

BackgroundIn response to COVID-19 pandemic, the Government of Uganda adopted public health measures to contain its spread in the country. Some of the initial measures included refusal to repatriate citizens studying in China, mandatory institutional quarantine, and social distancing. Despite being a public health emergency, the measures adopted deserve critical appraisal using an ethics and human rights approach. The goal of this paper is to formulate an ethics and human rights criteria for evaluating public health measures and use it to (...) reflect on the ethical propriety of those adopted by the government of Uganda to contain the spread of COVID-19.Main bodyWe begin by illustrating the value of ethics and human rights considerations for public health measures including during emergencies. We then summarize Uganda’s social and economic circumstances and some of the measures adopted to contain the spread of COVID-19. After reviewing some of the ethics and human rights considerations for public health, we reflect upon the ethical propriety of some of Uganda’s responses to COVID-19. We use content analysis to identify the measures adopted by the government of Uganda to contain the spread of COVID-19, the ethics and human rights considerations commonly recommended for public health responses and their importance. Our study found that some of the measures adopted violate ethics and human rights principles. We argue that even though some human rights can sometimes be legitimately derogated and limited to meet public health goals during public health emergencies, measures that infringe on human rights should satisfy certain ethics and human rights criteria. Some of these criteria include being effective, strictly necessary, proportionate to the magnitude of the threat, reasonable in the circumstances, equitable, and least restrictive. We reflect on Uganda’s initial measures to combat the spread of COVID-19 and argue that many of them fell short of these criteria, and potentially limit their effectiveness.ConclusionThe ethical legitimacy of public health measures is valuable in itself and for enhancing effectiveness of the measures. Such legitimacy depends on the extent to which they conform to ethics and human rights principles recommended for public health measures. (shrink)

On site monitoring of research is one of the most effective ways to ensure compliance during research conduct. However, it is least carried out primarily for two reasons: presumed high costs both in terms of human resources and finances; and the lack of a clear framework for undertaking site monitoring. In this paper we discuss a model for research site monitoring that may be cost effective and feasible in low resource settings.

This chapter provides a critical reflection on an ethnographic approach led by a non-Indigenous researcher in partnership with an Indigenous community-controlled health organization, and a team of Indigenous and non-Indigenous supervisors, advisors, critical friends, and mentors. The chapter explores the way the three interrelated principles of Indigenist research informed the study, as a critical reflection of the methodology’s achievement of a decolonizing research agenda. The flow of Maiwah provides a metaphor for the chapter’s diverse authorship. Maiwah’s tributaries, inlets, and banks (...) represent author voices at different points while the one River flowing represents coming together to form a broader collective story of the research that still respects the authors’ individual positioning. Maiwah’s flow also signifies the dialogical approach of the research – “tricky ground” for non-Indigenous researchers seeking to privilege Indigenous voices while remaining accountable to their own White privilege, particularly given that at its most basic level, research requires the “extraction of ideas” from participants. Yet, the flow of Maiwah also shows us the possibilities of research, where in this case, researcher and participants together cocreated new knowledge in support of their agendas. This process enabled both research outcomes and increased research capacity and confidence in the host agency and researcher. On this account, decolonizing research is perhaps more about relationship and devolving control over the process than it is about particular methods, and the respectful negotiation of epistemological meanings and representation of particular knowledges that can result. Paper, $27.95.This collection of essays testifies to the growing interest in neo-Kantianism in the Anglophone world. The editors boast that “it is the first of its kind published in English,” though they have been beat to the post by an (...) issue of the The Philosophical Forum (Vol. XXXIX, no. 2, Summer 2008), Back to Kant: Neo-Kantianism and its Relevance Today, edited by Andrew Chignell, Terence Irwin, and Thomas Teufel. Still, claims to priority are of small moment where quality is concerned, and the many valuable essays in this volume more than compensate for second place. In their introductory essay, Makkreel and Luft make a convincing case for the continuing relevance of neo-Kantianism in contemporary philosophy. Basically, nearly every philosophical movement of the twentieth century—phenomenology, existentialism, hermeneutics, positivism, Frankfurt school—was influenced by, or grew out of a reaction to, neo-Kantianism, so that we cannot understand and assess these movements unless we have a handle on neo-Kantianism itself. The editors missed a trick, however, when they failed to mention the concept of normativity, which plays such a big role in contemporary philosophy, and whose roots lie in neo-Kantianism.Despite the high quality of many of its essays, this volume suffers from a lack of balance and perspective. Contemporary scholars on neo-Kantianism tend to focus on the Marburg school, especially the work of Cohen, Cassirer, and Natorp. This volume reflects this bias: almost all the articles are centered on these figures. Only two essays focus on the Southwestern or Baden school: one on Emil Lask by Steven Crowell, another on Dilthey and the neo-Kantians by Makkreel. The latter article, however, is more a defense of Dilthey than a study of the neo-Kantians. The important contributions of the Southwestern school to value-theory, and the logic of history and the social sciences, receive scant treatment.The lack of balance is especially evident in the case of the neo-Friesian school, which is never mentioned. This school of neo-Kantianism prospered in Göttingen in the early twentieth century under the leadership of Leonard Nelson. Its members—the theologian Rudolf Otto (1869–1937), the psychiatrist Arthur Kronfeld (1886–1941), the Nobel Prize winner Otto Meyerhoff (1884–1951), and the mathematician Gerhard Hessenberg (1874–1925)—were eminent in their own right and advocated noble social and political causes. Their circle is of great cultural interest, and it deserves a place in history no less than the Marburg and Southwestern schools. Following Fries, Nelson developed an anthropological interpretation of Kant competing with the logicist interpretation of the Marburg and Southwestern schools. Nowadays Heidegger is given credit for the anthropological interpretation, though its origins ultimately go back to Fries.The bias in perspective becomes explicit in the essay by Manfred Kühn, “Interpreting Kant Correctly: On the Kant of the Neo-Kantians.” Kühn attempts to find the common [End Page 145] interpretation of Kant in the Marburg and Southwestern schools, and locates it in the Platonized version of Kant of the later Cohen, an interpretation that eliminates sensibility and stresses the autonomy of pure thought. Kühn’s generalization is problematic for three reasons: (1) It ignores the anthropological interpretation of the Friesian school; (2) it scarcely works for the Southwestern school, which never eliminated Kant’s sensibility (Kühn bases his interpretation on a single later essay by Rickert, as if it held for all his earlier work and for Windelband and Lask); and (3) it applies only to the later Cohen, who took the plunge toward an objective idealist interpretation only in his 1896 Einleitung mit kritischen Nachtrag zur neunten Auflage der Geschichte des Materialismus. Although there are indeed Platonic tendencies to Cohen’s thinking even in the late 1860s, they do not erase the Kantian dualism between understanding and sensibility, which remains well in place even in the second edition of Kant’s Theorie der Erfahrung (1885). Miller (1956) summarized evidence that people can remember about seven chunks in short-term memory (STM) tasks. However, that number was meant more as a rough estimate and a rhetorical device than as a real capacity limit. Others have since suggested that there is a more precise capacity limit, but that it is only three to five chunks. The present target article brings together a wide variety of data on capacity limits suggesting that the smaller capacity limit is real. Capacity limits (...) will be useful in analyses of information processing only if the boundary conditions for observing them can be carefully described. Four basic conditions in which chunks can be identified and capacity limits can accordingly be observed are: (1) when information overload limits chunks to individual stimulus items, (2) when other steps are taken specifically to block the recoding of stimulus items into larger chunks, (3) in performance discontinuities caused by the capacity limit, and (4) in various indirect effects of the capacity limit. Under these conditions, rehearsal and long-term memory cannot be used to combine stimulus items into chunks of an unknown size; nor can storage mechanisms that are not capacity-limited, such as sensory memory, allow the capacity-limited storage mechanism to be refilled during recall. A single, central capacity limit averaging about four chunks is implicated along with other, noncapacity-limited sources. The pure STM capacity limit expressed in chunks is distinguished from compound STM limits obtained when the number of separately held chunks is unclear. Reasons why pure capacity estimates fall within a narrow range are discussed and a capacity limit for the focus of attention is proposed. Following Wiggins’ seminal article, On Being in the Same Place at the Same Time, this article presents the first comprehensive account of the relation of material constitution, an asymmetrical, transitive relation which totally orders distinct ‘entities’ (individuals, pluralities or masses of stuff) which ‘spatially coincide.’ Their coincidence in space is explained by a recursive definition of ‘complete-composition’, weaker than strict mereological indiscernibility, which also explains the variety of logically independent similarities in such cases. This account is ‘analytical’, dealing with ‘putative’ (...) cases in general. The main strategy is to rationally reconstruct Aristotle’s notion of material cause. It is developed more fully with a theory of how to justify admitting generable and perishable things into the natural world, in The Kinds of Things: A Theory of Personal Identity Based on Transcendental Argument (Open Court, 1996). In Knowledge and Belief, Frederick Schmitt explores the nature and value of knowledge and justified belief through an examination of the dispute between epistemological internalism and externalism. Knowledge and justified belief are naturally viewed as belief of a sort likely to be true--an externalist view. It is also intuitive, however, to view them as an internal matter; justification must be accessible to the subject or constituted by the subject's epistemic perspective. The author argues against the view that internalism is (...) the historically dominant epistemology by examining closely the epistemological principles that underlie the treatment of skepticism in Plato, the Academic and Pyrrhonian skeptics, Descartes and Hume. Schmitt develops a sustained, detailed argument against many forms of internalism in favor of a reliabilist/externalist epistemology. His version of reliabilism, though strictly externalist, accommodates and explains the most durable intuitions alleged to support internalism. Knowledge and Belief assumes no knowledge of epistemology or its history. Readers of philosophy will find this an excellent introduction to ancient and modern epistemology; this systematic study of the internalist and externalist debate is the first of its kind. (shrink)

This book is the first complete intellectual biography of Hermann Cohen and the only work to cover all his major philosophical and Jewish writings. Frederick C. Beiser pays special attention to all phases of Cohen's intellectual development, its breaks and its continuities, throughout seven decades. The guiding goal behind Cohen's intellectual career, he argues, was the development of a radical rationalism, one committed to defending the rights of unending enquiry and unlimited criticism. Cohen's philosophy was therefore an attempt to (...) defend and revive the Enlightenment belief in the authority of reason; his critical idealism an attempt to justify this belief and to establish a purely rational worldview. According to this interpretation, Cohen's thought is resolutely opposed to any form of irrationalism or mysticism because these would impose arbitrary and artificial limits on criticism and enquiry. It is therefore critical of those interpretations which see Cohen's philosophy as a species of proto-existentialism or Jewish mysticism. Hermann Cohen: An Intellectual Biography attempts to unify the two sides of Cohen's thought, his philosophy and his Judaism. Maintaining that Cohen's Judaism was not a limit to his radical rationalism but a consistent development of it, Beiser contends that his religion was one of reason. He concludes that most critical interpretations have failed to appreciate the philosophical depth and sophistication of his Judaism, a religion which committed the believer to the unending search for truth and the striving to achieve the cosmopolitan ideals of reason. Frederick F. Schmitt offers a new account of Hume's epistemology in A Treatise of Human Nature, which alternately manifests scepticism, empiricism, and naturalism. Critics have emphasised one of these positions over the others, but Schmitt argues that they can be reconciled by tracing them to an underlying epistemology of knowledge and probability.

Histories of German philosophy in the nineteenth century typically focus on its first half--when Hegel, idealism, and Romanticism dominated. By contrast, the remainder of the century, after Hegel's death, has been relatively neglected because it has been seen as a period of stagnation and decline. But Frederick Beiser argues that the second half of the century was in fact one of the most revolutionary periods in modern philosophy because the nature of philosophy itself was up for grabs and the (...) very absence of certainty led to creativity and the start of a new era. In this innovative concise history of German philosophy from 1840 to 1900, Beiser focuses not on themes or individual thinkers but rather on the period's five great debates: the identity crisis of philosophy, the materialism controversy, the methods and limits of history, the pessimism controversy, and the Ignorabimusstreit. Schopenhauer and Wilhelm Dilthey play important roles in these controversies but so do many neglected figures, including Ludwig Büchner, Eugen Dühring, Eduard von Hartmann, Julius Fraunstaedt, Hermann Lotze, Adolf Trendelenburg, and two women, Agnes Taubert and Olga Pluemacher, who have been completely forgotten in histories of philosophy. This book is a philosophical exploration of the theoretical causes behind the collapse of classical cybernetics. Alcibiades Malapi-Nelson advances the idea that the cybernetic understanding of the nature of a machine entails ontological and epistemological consequences that create both material and theoretical conundrums. He proposes that, given our current state of materials, research, and practices, there might be a way for cybernetics to flourish. The book starts with a historical treatment of cybernetics, and proceeds with a philosophical explanation of (...) its collapse-emphasizing the work of Turing, Ashby and von Neumann-and connects it with the emerging technologies carrying its signature. The transhumanist metaphysics of both cybernetics and NBIC is then unveiled. Finally, avenues of research that may allow these technologies to circumvent the cybernetic fate are indicated. Legal decisions and theories are frequently condemned as formalistic, yet little discussion has occurred regarding exactly what the term "'formalism" means. In this Article, Professor Schauer examines divergent uses of the term to elucidate its descriptive content. Conceptions offormalism, he argues, involve the notion that rules constrict the choice of the decisionmaker. Our aversion to formalism stems from denial that the language of rules either can or should constrict choice in this way. Yet Professor Schauer argues that this aversion to (...) formalism should be rethought: At times language both can and should restrict decisionmakers. Consequently, the term "'formalistic" should not be used as a blanket condemnation of a decisionmaking process; instead the debate regarding decision according to rules should be confronted on its own terms. This paper examines the moral arguments for and against employees' blowing the whistle on illegal or immoral actions of their employers. It asks whether such professional dissidents are justified in disclosing wrongdoing by others while concealing their own identity. Part I examines the concept of anonymity, distinguishing it from two similar concepts — secrecy and privacy. Part II analyzes the concept of whistleblowing using recent definitions by Bok, Bowie and De George. Various arguments against anonymous whistleblowing are identified and evaluated. (...) Alvin Plantinga has famously responded to the logical problem of evil by appealing to the intrinsic value of significant free will. A problem, however, arises because traditional theists believe that both God and the redeemed who go to heaven cannot do wrong acts. This entails that both God and the redeemed in heaven lack significant freedom. If significant freedom is indeed valuable, then God and the redeemed in heaven would lack something intrinsically valuable. However, if significant freedom is not intrinsically (...) valuable, then Plantinga’s reply to the logical problem of evil fails. In this paper, we assess three contemporary solutions to the dilemma above. The first is the love solution, which proposes that significant freedom is necessary for agents to love, and loving others is intrinsically good. The second is the soul-making solution, which argues that significant freedom is necessary for self-developing one’s moral character, and having a self-developed moral character is intrinsically good. The third is the derivative free will solution, which argues that significant freedom is necessary for derivative free will in heaven, and derivative free will is intrinsically good. We raise problems against all three solutions and instead defend a fourth solution – the ultimate responsibility solution. That is, significant freedom is instrumentally valuable as it gives agents ultimate responsibility with regards to morally significant acts. Finally, we defend the ultimate responsibility solution against two major objections. (shrink)

This book is the first translation into English of the Reflections which Kant wrote whilst formulating his ideas in political philosophy: the preparatory drafts for Theory and Practice, Toward Perpetual Peace, the Doctrine of Right, and Conflict of the Faculties; and the only surviving student transcription of his course on Natural Right. Through these texts one can trace the development of his political thought, from his first exposure to Rousseau in the mid 1760s through to his last musings in the (...) late 1790s after his final system of Right was published. This paper traces the application of information theory to philosophical problems of mind and meaning from the earliest days of the creation of the mathematical theory of communication. The use of information theory to understand purposive behavior, learning, pattern recognition, and more marked the beginning of the naturalization of mind and meaning. From the inception of information theory, Wiener, Turing, and others began trying to show how to make a mind from informational and computational materials. Over the last 50 years, (...) many philosophers saw different aspects of the naturalization of the mind, though few saw at once all of the pieces of the puzzle that we now know. Starting with Norbert Wiener himself, philosophers and information theorists used concepts from information theory to understand cognition. This paper provides a window on the historical sequence of contributions made to the overall project of naturalizing the mind by philosophers from Shannon, Wiener, and MacKay, to Dennett, Sayre, Dretske, Fodor, and Perry, among others. At some time between 1928 and 1948, American engineers and mathematicians began to talk about `Theory of Information' and `Information Theory,' understanding by these terms approximately and vaguely a theory for which Hartley's `amount of information' is a basic concept. I have been unable to find out when and by whom these names were first used. Hartley himself does not use them nor does he employ the term `Theory of Transmission of Information,' from which the two other shorter terms presumably were derived. It seems that Norbert Wiener and Claude Shannon were using them in the Mid-Forties. (shrink)

People intend to do things, try to do things, and do things. Do they also will to do things? More precisely, if people will to do things and their willing bears upon what they do, is willing, or volition, something distinct from intending and trying? This question is central to the intention/volition debate, a debate about the ingredients of the best theory of the nature and explanation of human action. A variety of competing conceptions of volition, intention, and trying have (...) been advanced in the literature; it would be impossible to examine each thoroughly in a single paper. We can show, however, that the major functional roles ascribed to volition are nicely filled by a triad composed of intention, trying, and information feedback. Sections I and II below develop an account of the connection between intention and trying. Section III examines leading arguments for the existence of volitions and decomposes volitions into members of the triad just identified. (shrink)

Theories of epistemically justified belief have long assumed individualism. In its extreme, or Lockean, form individualism rules out justified belief on testimony by insisting that a subject is justified in believing a proposition only if he or she possesses first-hand justification for it. The skeptical consequences of extreme individualism have led many to adopt a milder version, attributable to Hume, on which a subject is justified in believing a proposition only if he or she is justified in believing that there (...) is testimony in favor of the proposition deriving from a reliable source. I argue that this Humean individualism also leads to skepticism in a wide range of cases; it makes it impossible for a layperson to be justified on expert testimony. In addition, I argue that the apparent motivation for the Humean view, an insistence on intellectual autonomy in justification, does not succeed in motivating it. I then explore the contours of a collectivist view of justification on testimony, with special attention to the place of a subject's intellectual autonomy in such justification. I try to bring empirical results of the psychology of persuasion to bear on the epistemological issues. (shrink)

A great deal of attention has been paid in recent years to the function- al roles of intentions in intentional action. In this paper we sketch and defend a position on this issue while attacking a provocative alternative. Our position has its roots in a cybernetic theory of purposive behavior and is only part of the larger task of understanding all goal-directed behavior. In this comprehensive assessment of Kant's metaethics, Frederick Rauscher shows that Kant is a moral idealist rather than a moral realist and argues that Kant's ethics does not require metaphysical commitments that go beyond nature. Rauscher frames the argument in the context of Kant's non-naturalistic philosophical method and the character of practical reason as action-oriented. Reason operates entirely within nature, and apparently non-natural claims - God, free choice, and value - are shown to be heuristic and to reflect reason's (...) ordering of nature. The book shows how Kant hesitates between a transcendental moral idealism with an empirical moral realism and a complete moral idealism. Examining every aspect of Kant's ethics, from the categorical imperative to freedom and value, this volume argues that Kant's focus on human moral agency explains morality as a part of nature. In Stability and Justification in Hume’s Treatise, Louis Loeb ascribes to Hume a naturalistic account of justified belief, one on which Hume is fundamentally concerned with the question whether stable belief can be achieved. Loeb’s interpretation is systematic, richly explanatory, and powerfully argued. He makes a compelling case that stability plays a central role in Hume’s epistemology. Loeb’s case is so compelling indeed that anyone who wants to defend an alternative interpretation will now have to assimilate or deflect the massive (...) textual evidence in favor of the stability interpretation. I will argue here that, for some passages Loeb cites in favor of the stability interpretation, a veritistic interpretation explains the text at least as well as the stability interpretation does.
